How to Obtain Guardianship

Why Use a Legal Document Preparer?

Guardianship is a serious legal matter that involves preparation, process service, and appearing before a judge.

Unless you are familiar with probate court, it could be beneficial to hire a professional. That being said, many people unfortunately find a lawyer is too costly. This is where a legal document preparer is useful.

As an Arizona Certified Legal Document Preparer, Senior Planning assists with the guardianship process.

We make sure you have all of the necessary paperwork filled out correctly before your court date. We provide the services you need at affordable rates to make your filing smooth and hassle-free.

Once hired, we will get the paperwork to you promptly, so you can file ASAP.

Doctors may recommend guardianship for the safety of a patient with Alzheimer’s or dementia. Guardianship may also be needed to apply for benefits and long-term care.

As a document preparer, Senior Planning cannot provide legal advice or represent you in court, but we can discuss together your case and whether guardianship is necessary.

Pre-Assessment

1

Many filings are fairly straightforward and do not require an attorney.

Generally, if you are able to show a judge that guardianship is required, you will not have any issues.

Although we cannot speak on your behalf at court, as an attorney would, one of our agents can accompany you for the filing for an additional, reasonable fee.

If your case is contested or requires an attorney, we can refer you to a local Arizona guardianship attorney.

The Court Hearing

2

Emergency hearings can be held anywhere from the same day to within one week, while permanent petitions can take anywhere from two weeks to over two months.

It depends on the circumstances of the case, where you are filing, and the court’s caseload at time of filing.

We prepare each filing exclusively for the case at hand to achieve the best results possible.
